THE FOLLOWING SWEEPSTAKES IS VALID ONLY IN THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA AND IS OPEN ONLY TO PERSONS QUALIFIED AS ENTRANTS (AS DEFINED IN THE OFFICIAL RULES BELOW). VOID ELSEWHERE AND WHEREVER PROHIBITED. DO NOT PARTICIPATE IN THE SWEEPSTAKES IF YOU DO NOT FALL WITHIN THE ELIGIBILITY REQUIREMENTS AS SET FORTH BELOW.
By entering or participating in the Mercedes-Benz The Open Sweepstakes (the “Sweepstakes”), you (“You”, and an, “Entrant”) unconditionally accept and agree to be bound by, comply with and abide by these Official Rules (the “Official Rules”), including eligibility requirements, the decisions of Mercedes-Benz USA, LLC (the “Sponsor”), US Sweepstakes & Fulfillment Co. (the “ Sweepstakes Administrator”), and the results of the Sweepstakes, as determined by Sponsor which shall be final and binding in all respects. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. Sweepstakes is subject to all applicable federal, state and local laws and regulations and is void where prohibited by law.
1. SPONSOR / SWEEPSTAKES ADMINISTRATOR: Sponsor: Mercedes-Benz USA, LLC, 1 Mercedes-Benz Drive, Sandy Springs, GA 30328. / Sweepstakes Administrator: US Sweepstakes & Fulfillment Co., 1630 30th St., STE A593, Boulder, CO 80301.
2. SWEEPSTAKES ENTRY PERIOD: The Sweepstakesbegins at 12:00:01 AM Eastern Time (“ET”) on Monday, May 4, 2026 and ends at 11:59:59 PM ET on Sunday, June 7, 2026 (the “Sweepstakes Period”). Sponsor’s computer is the official time-keeping device for the Sweepstakes.
3. ELIGIBILITY: The Sweepstakes is open only to participation by legal residents of the 50 United States, including the District of Columbia, who are age 18 or older and the age of majority in their state of residence (age 19 and older in Alabama and Nebraska; age 21 and older in Mississippi) at the time of entry and have a valid passport with a minimum validity through July 31, 2026. Void in Puerto Rico, Guam, the U.S. Virgin Islands, all other U.S. territories and possessions, outside the U.S., and wherever else prohibited by law. Employees, officers and directors of Sponsor, Sweepstakes Administrator, R&A Championships Limited, Royal Birkdale Golf Club, and their respective franchisees, owners, employees, contractors, parents, affiliated companies, subsidiaries, distributors, retailers, wholesalers, printers, advertising and promotion agencies of each and any and all other companies and local sponsors associated with the design or execution of this Sweepstakes, and the immediate family members (spouses, parents, children, and siblings and their spouses) of, and/or those living in the same household of each, whether or not related, are not eligible to enter.
Sponsor reserves the right not to award the Grand Prize (as defined below) if Sponsor is aware or has reasonable grounds to believe that a Potential Winner or Winner is not eligible for any reason.
4. HOW TO ENTER: During the Sweepstakes Period, visit https://theopen.mbusaevents.com (the “Sweepstakes Website”) and follow all entry instructions to complete the required fields within the online entry form and submit to receive one (1) entry into the Sweepstakes (the “Online Entry”). Upon submitting an Online Entry, Entrants will have the opportunity to earn five (5) additional entries into the Sweepstakes (the “Bonus Entries”) by answering five (5) survey questions. Entrants must follow the instructions to answer and submit all five (5) survey questions to receive the Bonus Entries. Entrants are not required to answer the survey questions to receive an Online Entry.
Online Entries and Bonus Entries are collectively referred to herein as “Entry” or “Entries”. Entries may only be submitted and received between Monday, May 4, 2026 at 12:00:01 AM ET and Sunday, June 7, 2026 at 11:59:59 PM ET. There is a limit of one (1) Online Entry and five (5) Bonus Entries per person during the Sweepstakes Period. Although subsequent attempts to enter may be received, only the first complete Online Entry and Bonus Entries (if applicable) received from a particular Entrant will be eligible; subsequent attempts by the same person to enter, including entries submitted with an alternate email address, will be disqualified. Any registration, attempted entry, or Entry that is incorrect, incomplete or submitted with an invalid email address will be invalidated, void and disqualified. Registering more than one time during the entire Sweepstakes Period (including, but not limited to, registering more than one time by using the same or alternate names or using multiple/different email addresses, identities, registrations or logins, or any other methods) will invalidate, void and disqualify all Entries by that Entrant. Any use of unauthorized robotic, repetitive, automatic, programmed or similar entry methods or agents (including, but not limited to, sweepstakes entry services) will invalidate, void and disqualify all Entries by Entrant.
All Entries become the property of the Sponsor and will not be acknowledged or returned. Photocopied, illegible, or mechanically reproduced Entries are not eligible. Any incorrect, incomplete or illegible Entries will be disqualified. Sponsor is not responsible for lost, late, damaged, misdirected, illegible, incomplete, invalid, unintelligible or postage-due mailed Entries, or for entries submitted in a manner that is not expressly allowed under these Official Rules, or for any Entry not submitted or received due to any technical error or failure, unauthorized human intervention, inaccurate capture or mis-entry of any required information, or the failure to capture any such information for any reason including programming or technical errors, or effects of hackers or failure of any electronic equipment, computer or cellular transmissions and/or network connections; all of which will be disqualified.
Each Entrant must submit an Entry on his/her own behalf. Any Entry submitted on behalf of another individual or using another person’s email address, name or mobile number will be disqualified and ineligible to claim any Prize. Any attempt by any Entrant to obtain more than the stated number of entries allowed by using same, multiple/different mobile numbers, identities, or any other methods will void that Entrant's Entries and that Entrant will be disqualified. No mechanically-reproduced or automated entries permitted. Use of any automated system to participate is prohibited and will result in disqualification and all such entries will be deemed void.
By participating and submitting an Entry, Entrant agrees that Sponsor and its designated parties are authorized to contact Entrant via email, mail, phone or any other form of media to make Entrant aware of information pertinent to the Sweepstakes, and to distribute information regarding the Sponsor’s featured products, special events or future Sweepstakes, promotions or offers. Entrants may opt-out of any further email communication at any time by simply replying to any email message or following the provided opt-out instructions. Entrants are subject to all notices posted online including but not limited to the Sponsor’s Privacy Policy, which can be found at https://www.mbusa.com/en/legal-notices/privacy-statement.
Important Notice for means of entry from cellular devices. Message and data rates may apply to use of mobile phone/device in conjunction with participating in Sweepstakes. Entrant's wireless service provider may charge Entrant for data usage, and Entrant shall be responsible for any and all costs associated with such attempts to participate and this form of entry in the Sweepstakes. Please consult your wireless service provider regarding their pricing plans. Entrant must be a wireless service subscriber with data usage, using a participating service provider in order to enter via this method. Not all wireless phone providers carry the necessary service to participate. Entrant should check their phone and service capabilities for specific mobile internet instructions.
5. PRIZE/APPROXIMATE RETAIL VALUE (“ARV”)/ODDS: There is a total of one (1) Grand Prize (as defined below) available to be won. One (1) Grand Prize winner (“Winner”) will receive a trip package for two (2) people, Winner and one (1) guest (the “Guest”), to Southport, England to attend The 154th Open at Royal Birkdale from July 15, 2026 to July 20, 2026. Grand Prize trip package (the “Grand Prize”) includes:
The ARV of Grand Prize: $14,000. The ARV may vary based upon dates of travel and point of departure. The difference between the ARV and actual value of the Grand Prize will not be awarded. Odds of winning will depend upon the total number of eligible Entries received during the Sweepstakes Period. *If cost of round-trip, coach-class air-transportation for Winner and Guest to Southport, England exceeds $5,000, Winner will be awarded a $5,000 airline voucher in lieu of scheduled round-trip flights and Winner will be responsible for booking their own air-transportation for themselves and their Guest to/from Southport, England, and any incremental costs and fees will be the responsibility of the Winner. If applicable, airline voucher will not be replaced if lost or stolen and will be subject to the issuing company’s complete terns and conditions, including expiration dates.
This Sweepstakes is in no way sponsored, endorsed, administered by, or associated with, the R&A Championships Limited or Royal Birkdale Golf Club.
6. GRAND PRIZE CONDITIONS: The Grand Prize is not redeemable for cash, assignable, transferable and may not be substituted except at Sponsor’s sole discretion. Sponsor reserves the right to substitute the Grand Prize and any of its components of equal or greater value at its discretion. Any difference between the stated value and actual value of Grand Prize will not be awarded.Any other incidental expenses on Grand Prize not specified herein, including but not limited to any incidental expenses by Winner’s Guest, are the Winner’s sole responsibility. Only the number of prizes stated in these Official Rules is available to be won in the Sweepstakes. If, by reason of a print or other error, more prizes are claimed than the number set forth in these Official Rules, winners will be determined in a random drawing from among all eligible claimants making purportedly valid claims to award the advertised number of prizes available. Winner is solely responsible for all federal, state, local and income taxes associated with winning Grand Prize.
Grand Prize Trip Package Terms and Conditions: Winner’s Guest must be a legal U.S. resident,18 years or older and the age of majority in their state of residence. Guest must complete and return a Travel Companion Liability & Publicity Release prior to travel as noted below. If Winner elects to travel or partake in the Grand Prize with no Guest, no additional compensation will be awarded.
All travel related expenses, including but not limited to, taxes, gratuities, incidentals, upgrades, insurance, service charges, airport surcharges, departure taxes, hotel, resort or property fees, luggage fees, food & beverage and personal expenses are the sole responsibility of Winner and/or Guest. Photo identification and credit card or cash deposit may be required at any time for incidental charges (e.g., room service, use of telephone/IT services, laundry and all other optional extra services not provided in the Grand Prize). Any person that participates in the Grand Prize that is not deemed to be the Guest must pay their own expenses. Winner and Guest must travel on same itinerary. Winner and Guest are responsible for obtaining the proper travel documentation and must have a valid passport with a minimum validity through July 31, 2026 prior to travel. Trip must be booked at least two (2) weeks in advance and is only available from July 15, 2026 to July 20, 2026. Trip must be used on dates specified by the Sponsor or Grand Prize will be forfeited in its entirety. Once booked, the Grand Prize cannot be amended or cancelled. Unless otherwise specified within, travel arrangements must be made through an agent of the Sponsor and on an airline carrier of Sponsor’s choice. All reservations are subject to availability and accommodations are subject to availability at time of reservation. Blackout dates, advance booking requirements and travel restrictions may apply. Availability is subject to factors such as weather, seasonality and space availability. Sponsor will, in its sole discretion, determine which airport is closest to the Winner’s home. Winner and their Guest are responsible for obtaining any travel insurance (and all other forms of insurance) that they may wish to obtain (at their own expense) and hereby acknowledge that the Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. Winner and Guest must agree to abide by all air carrier, hotel, venue, transportation, and any other prize-related activity rules and regulations in effect. Failure to do so may result in forfeiture of Grand Prize and no other substitution or compensation will be provided in lieu thereof.
If weather or other incident or conditions beyond the control of the Sponsor affects the ability for the Winner and Guest to redeem any portion of the Grand Prize during the scheduled date and time, then the Sponsor shall have no further obligation to the Winner and/or Guest other than to supply the remaining elements of the Grand Prize minus the unused portion of prize. Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, hotels, venue operators, transportation companies, prize providers or any other persons, businesses or organizations providing any prize-related services or accommodations. Sponsor is not liable for expenses incurred as a consequence of flight cancellation/delay. No refund or compensation will be made in the event of the cancellation or delay of any transportation or other prize element except at the sole and absolute discretion of Sponsor. Travel is subject to the terms and conditions set forth in these Official Rules, and those set forth by airline carrier as detailed in the passenger ticket contract. The passenger contracts in use by the airline or other transportation companies shall constitute the sole contracts with respect to the Winner’s and their Guest’s transportation and such contracts shall be solely between the Winner, Guest, and such transportation companies. Trip components issued in connection with the Grand Prize may not be eligible for frequent flyer miles, other rewards programs or upgrades. If for any reason whatsoever, Winner and/or Guest are unable to travel after all travel arrangements have been made and paid, the Sponsor shall have no further obligation to the Winner. If Grand Prize is forfeited prior to Sponsor finalizing and paying for travel, and there is sufficient time to notify an alternate winner, the Grand Prize will be awarded to an alternate winner in a separate random drawing from among all non-winning eligible Entries.
In the event Winner and/or Guest engages in behavior that, as determined by the Sponsor in its sole discretion, is obnoxious or threatening, illegal, that is intended to annoy, abuse, threaten or harass any other person, or that in any way disparages or adversely affects the reputation, image, and/or customer goodwill of Sponsor or any of Sponsor’s services, products, trademarks, service marks, or logos, Sponsor reserves the right to terminate the trip early, in whole or in part, and send the Winner and/or Guest home with no further obligation or compensation whatsoever to Winner and/or Guest. In the event Winner and/or Guest engages in behavior during travel that (as determined by Sponsor in its sole discretion) is illegal, tortious, or subjects winner to arrest or detention, Sponsor shall have no obligation to pay any damages, fees, fines, judgments or other costs or expenses of any kind whatsoever incurred by Winner and/or Guest as a result of such conduct.
Sponsor is not the provider of the Event, which is managed or controlled by an independent third party, and Sponsor has no power to manage or control the operations of the Event or any third party provider. Sponsor bears no responsibility if the Event, or any component of the Grand Prize, is canceled, delayed, postponed, or becomes unavailable for any reason. Sponsor makes no guarantees or warranties about Event tickets or the Event itself. Event tickets are not redeemable for cash and will not be replaced if lost or stolen. Event tickets are subject to the issuing company’s complete terms and conditions. In the event that the Event, or any component of the Grand Prize, does not take place as scheduled, for reasons such as cancellation, preemption or postponement, or for any reason beyond the control of the Sponsor, Sponsor's sole responsibility will be to award the remaining portion of the Grand Prize and no additional substitution or compensation will be provided. Winner will not receive compensation from Sponsor for Event tickets that the Winner and/or their Guest are unable to use due to loss, damage, destruction (and such will not be replaced), or delay or cancellation of the Event, but tickets may be subject to standard rain-check policies and procedures set by the issuer. Winner agrees that event admission is awarded pursuant to a revocable, nontransferable license that is personal to that applicable Winner, and may not be sold, resold, auctioned, bartered, assigned, exchanged, placed in commerce, transferred, given away, donated, or otherwise conveyed. Sponsor will not be responsible for weather conditions; acts of God; acts of terrorism; civil disturbances; local, state, or federal regulation, order, or policy; work stoppage; epidemic, pandemic, or any other issue concerning public health or safety; or any other event outside of their control that may cause the cancellation or postponement of the Event. Event tickets/passes awarded as prizes may not be resold, offered for resale, or used for any commercial or promotional purpose whatsoever. Any such resale or commercial or promotional use may result in disqualification and prize forfeiture and may invalidate the license granted by the Event ticket.
Grand Prize is awarded as is, without any warranty, express or implied, by Sponsor. Failure to collect or properly claim the Grand Prize in accordance with these Official Rules will result in forfeiture of the Grand Prize.
SPONSOR SHALL HAVE NO LIABILITY FOR ANY PERSONAL INJURIES, DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES OR EXPENSES RESULTING FROM OR ARISING OUT OF ANY TRAVEL RELATED TO THE GRAND PRIZE OR ANY OTHER ASPECT OF WINNER’S ACCEPTANCE OR USE OF THE GRAND PRIZE.
7. RANDOM DRAWING: The potential Winner (“Potential Winner”) will be selected in a random drawing on or about Monday, June 8, 2026 (“Drawing Date”) from among all eligible Entries received during the Sweepstakes Period by the Sweepstakes Administrator, an independent representative of the Sponsor whose decisions are final. Non-winning Entries will not ‘roll over’ to a subsequent drawing, if any, and shall be void immediately following the Drawing Date associated with the Sweepstakes, except that each eligible Entry will be considering a remaining eligible Entry in the event Sponsor elects, in its sole discretion, to select alternate Potential Winner(s) as described in these Official Rules.
8. WINNER NOTIFICATION & VERIFICATION: The Potential Winner will be notified by the Sweepstakes Administrator via email and/or phone (the “Notification”) and will be required to sign and return, within 72 hours of Sweepstakes Administrator initiating the Notification, an Affidavit of Eligibility, a Liability Waiver, an IRS W-9 Form and where allowable, a Publicity Release (collectively, "the Releases"). These Releases will require the Potential Winner to furnish their Social Security Number for the sole purpose of tax reporting as required by law, and to provide proof of Potential Winner’s valid passport with a minimum validity through July 31, 2026. Potential Winner’s Guest will also be required to sign a Travel Companion Liability & Publicity Release and provide proof of valid passport with a minimum validity through July 31, 2026. If the Potential Winner does not respond to the Notification with the required information and within the required timeframe, such Potential Winner will be disqualified, their claim on the Grand Prize will be forfeited and an alternate Potential Winner may be notified.
Potential Winner and their Guest may also be required to submit to a background check to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Sweepstakes will not bring Sponsor into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Sweepstakes or Sponsor, as determined by Sponsor in its sole discretion. Sponsor reserves the right to disqualify the Potential Winner and/or their Guest on the basis of the findings resulting from such background check or if the Potential Winner and/or their Guest fails to properly authorize and/or provide the required information in connection with such background check.
Subject to these Official Rules, upon successful completion of the background check after Potential Winner’s return of Potential Winner’s complete and properly executed Releases and Guest’s Guest Release, any other reasonable documentation that may be required by Sponsor and Sweepstakes Administrator in response to Notification, Sweepstakes Administrator shall determine and designate Potential Winner to be the verified Winner.
If a prize notification or prize/prize component is returned as undeliverable, or if a Potential Winner or verified Winner is found to be ineligible or not in compliance with these Official Rules, that Potential Winner or Winner will be disqualified, and the Grand Prize may be awarded to an alternate winner in a separate random drawing. If Sponsor is unable to determine and verify a Potential Winner after repeated alternate drawings (if time allows) or if Sponsor fails to receive a sufficient number of Entries to correspond to the number of prizes available to be awarded, Sponsor reserves the right to not award such prize(s).
NEITHER AN ENTRANT NOR A POTENTIAL WINNER IS A WINNER OF ANY PRIZE, EVEN IF THE SWEEPSTAKES SHOULD SO INDICATE, UNLESS AND UNTIL ENTRANT’S ELIGIBILITY, AND WINNER STATUS HAVE BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOT ACCEPT SCREEN SHOTS OR OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS.
9. PUBLICITY RELEASE: Except where prohibited by law, entry and acceptance of prize constitute permission to use Winner's name, prize won, hometown, likeness, video recordings, photographs, and statements for purposes of advertising, promotion and publicity (including online posting) in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification or permission.
10. GENERAL: Entrantsagree to these Official Rules and the decisions of the Sponsor and the Sweepstakes Administrator, and release the Sponsor, the Sweepstakes Administrator, R&A Championships Limited, Royal Birkdale Golf Club, and their affiliated companies, and all other businesses involved in this Sweepstakes, as well as the employees, officers, directors and agents of each (the “Released Parties”), from all claims and liability relating to their participation in the Sweepstakes, and the acceptance and use/misuse of the Grand Prize offered. Entrants assume all liability for and Released Parties shall be held harmless against any liability for any injury, losses or damages of any kind to persons, including personal injury or death, or injury to property caused or claimed to be caused in whole or in part, directly or indirectly, by participation in this Sweepstakes, acceptance, possession, or use/misuse of the Grand Prize, or any claims based on publicity rights, defamation or invasion of privacy, or merchandise delivery. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of the Grand Prize. Entrants further agree that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Sweepstakes.
In the event of a dispute over the identity of an Entrant, Entry will be deemed submitted by the "Authorized Account Holder" of the e-mail address submitted at time of entry. Authorized Account Holder means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor may ask any Entrant or Potential Winner or Winner to provide Sponsor with proof, to Sponsor’s satisfaction, that such party is the authorized account holder of the email address associated with the Entry. Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. The Released Parties are not responsible for: (i) lost, late, misdirected, damaged or illegible entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to Entrant's or any other person's computer related to or resulting from attempting to participate in or participating in the Sweepstakes. By participating in the Sweepstakes, Entrant (i) agrees to be bound by these Official Rules, including all eligibility requirements, and (ii) agrees to be bound by the decisions of Sponsor and the Sweepstakes Administrator, which are final and binding in all matters relating to the Sweepstakes. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes.
Sponsor reserves the right to cancel, terminate, suspend and/or modify the Sweepstakes, or any part of it, if, in the opinion or the Sponsor in its sole discretion, any fraud, misconduct or technical failures or any factor beyond Sponsor’s reasonable control destroys, impairs or threatens to impair the integrity or proper functioning of the Sweepstakes, if a computer virus, bug, or other technical problem corrupts the administration, security, or proper conduct of the Sweepstakes, if there is a change or cancellation of any event at which Entries are submitted or to which Prizes provide admission or attendance of, or if registration may not be conducted or completed for any event due to COVID-19 or any other reason. If, for any reason, the Sweepstakes cannot be run as planned or in the event of early termination or impairment of the Sweepstakes, Sponsor may disqualify any suspect Entries, Entrants, Potential Winners or Winners from the Sweepstakes and any sweepstakes it sponsors and , in its sole discretion (a) suspend the Sweepstakes and modify the Sweepstakes to address the impairment, then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; and/or (b) award the Grand Prize at random from among the eligible, non-suspect Entries received up to the time/date of such termination or impairment.
THE RELEASED PARTIES ARE NOT RESPONSIBLE IF THIS SWEEPSTAKES CANNOT BE ADMINISTERED OR CONDUCTED OR ANY PRIZE CANNOT BE AWARDED DUE TO CANCELLATIONS, DELAYS, OR INTERRUPTIONS RESULTING OR ARISING FROM ACTS OF GOD, WAR, OR TERRORISM, CIVIL UNREST, STRIKES, SUPPLY SHORTAGES, NATURAL DISASTERS, WEATHER, EPIDEMICS, COMPLIANCE WITH ANY LAW OR ORDER OF A GOVERNMENTAL AUTHORITY, OR ANY OTHER SIMILAR ACT, EVENT, OR OCCURRENCE BEYOND THE REASONABLE CONTROL OF THE SPONSOR. 11. DISPUTES: By participating, each Entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of Georgia; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering or attempting to enter this Sweepstakes, but in no event attorneys' fees; and (3) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. ENTRANT HEREBY WAIVE ANY RIGHTS OR CLAIMS TO ATTORNEY'S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ENTRANT, IDENTIFIABLE PERSONS, OR THIRD PARTY PARTICIPANTS, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Entrant and Sponsor in connection with this Sweepstakes, shall be governed by, and construed in accordance with the laws of the State of Georgia, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Georgia or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of Georgia.
12. PRIVACY: As a condition of entering the Sweepstakes, each Entrant gives consent for Sponsor to obtain and deliver their name, address and other information to third parties, including Sweepstakes Administrator, for the purpose of administering this Sweepstakes and to comply with applicable laws, regulations and rules, including, without limitation, the storing of your personal information for purposes of complying with state record retention requirements. Any information Entrant provides to Sponsor may be used to communicate with Entrant in relation to this Sweepstakes or on a Sweepstakes winner’s list. Personal information collected from Entrants are subject to the Sponsor’s Privacy Policy, which can be found at https://www.mbusa.com/en/legal-notices/privacy-statement. By participating in the Sweepstakes, you hereby agree to Sponsor’s collection and usage of your personal information and acknowledge that you have read and accepted Sponsor’s privacy policy.
13. SEVERABILITY: If any provision of these Official Rules shall be held invalid, illegal, or unenforceable, such provision shall be enforced to the maximum extent permitted by law and the Sponsor’s fundamental intentions hereunder, and the remaining provisions shall not be affected or impaired, provided, however, that in such cases the parties oblige themselves to use their best efforts to achieve the purpose of the invalid provision by a new legally valid stipulation.
